No confession, no deal

Brazilian criminal justice is changing, and the old traditional criminal process is giving way to the so-called negotiated justice. The latest chapter in this change is the non-prosecution agreement (“ANPP”), introduced into our Code of Criminal Procedure by the much-discussed Anti-Crime Package. Inspired by the North American experience of resolving criminal cases, which seeks efficiency and savings in judicial resources, the Brazilian legislator imported this institute, which is nothing more than an agreement signed between the investigated party and the Public Prosecutor's Office, in which the State waives the right to initiate criminal proceedings in exchange for compliance with certain measures imposed on the investigated party.
